Form Theory, LLC, doing business as Aligné Studios (“Aligné,” “we,” “us,” or “our”), respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains what information we collect, how we use and share it, and the choices and rights you have. It applies to information we collect at our studio at 300 Allen Toussaint Blvd, New Orleans, Louisiana, through our website at alignestudios.co (the “Site”), through our booking and scheduling platform, and through our classes, communications, events, and other services (collectively, the “Services”).
By using our Services, booking a class, creating an account, or providing us with your information, you agree to the practices described in this Privacy Policy.
1. Information We Collect
a. Information you provide directly
Identity and contact information — name, email address, phone number, mailing address, and date of birth;
Account and booking information — username, password, class reservations, attendance history, membership and package details, and preferences;
Payment information — billing address and payment card or bank details, processed by our third-party payment processor (we do not store full card numbers);
Health and wellness information you choose to share — injuries, medical conditions, pregnancy status, fitness goals, or limitations you disclose to us or our instructors so we can serve you safely;
Waivers and agreements — liability waivers, consents, and emergency contact information; and
Communications — messages, feedback, survey responses, and reviews you send to us.
b. Information collected automatically on our Site
Device and usage data — IP address, browser type, device identifiers, pages viewed, and dates and times of access;
Cookies, pixels, and similar technologies — including analytics and advertising technologies such as the Meta (Facebook) Pixel and Google advertising tags, used to operate the Site, measure performance, and deliver relevant ads (see Section 4); and
Location information — general location derived from your IP address.
c. Information collected at the studio
Security cameras — our premises are monitored by security cameras for safety and loss-prevention purposes; and
Photographs and video — we may capture images or recordings during classes and events for marketing, subject to the opt-out described in Section 7.
d. Information from third parties
Our booking, scheduling, and marketing platforms (Mariana Tek and Xplor Growth) and our payment processor;
Social media and advertising platforms (such as Meta and Google) when you interact with our pages or click our ads; and
Analytics, marketing, and referral partners.
2. How We Use Your Information
We use your information to:
Provide, operate, and improve the Services, including booking classes, managing memberships, and processing payments;
Communicate with you about reservations, schedule changes, account matters, and customer support;
Personalize your experience and tailor class recommendations and programming;
Protect health and safety — using the medical and emergency information you provide to deliver Services safely and respond to emergencies;
Send marketing and promotional communications, and deliver and measure advertising (including on social media and search platforms) — you may opt out as described in Sections 4 and 6;
Operate and secure our premises (including camera monitoring), prevent fraud, and protect the rights, property, and safety of Aligné, our staff, and our clients;
Conduct analytics to understand how our Services are used; and
Comply with legal obligations and enforce our agreements, including our waivers and Terms.
3. How We Share Your Information
We do not sell your personal information for monetary consideration. We may share your information in the following circumstances:
Service providers — vendors who perform services on our behalf, such as booking/scheduling software (Mariana Tek), marketing/email (Xplor Growth), payment processors, SMS and email providers, IT and hosting, and analytics, permitted to use the information only to provide those services;
Advertising and analytics partners — through cookies and advertising technologies (such as the Meta Pixel and Google tags), we share certain online identifiers and activity to deliver and measure ads. Under some state laws this is considered “sharing” or “targeted advertising,” and you may opt out (see Sections 4 and 10);
Business transfers — in connection with a merger, sale, financing, or acquisition of all or part of our business;
Legal and safety — when required by law, subpoena, or legal process, or to protect the rights, property, or safety of Aligné, our clients, or others;
With your direction or consent; and
Aggregated or de-identified data — information that does not identify you, which we may use and share for any lawful purpose.
4. Cookies, Analytics & Advertising Technologies
Our Site uses cookies, pixels, and similar technologies for three purposes: (1) essential cookies that make the Site work; (2) analytics (such as Google Analytics) to measure performance; and (3) advertising/retargeting
technologies (such as the Meta Pixel and Google Ads tags) that help us show and measure ads to people who have visited our Site.
Your choices. You can control cookies through your browser settings; disabling some cookies may affect Site functionality. You can opt out of interest-based advertising through your device and ad-platform settings (for example, your Meta and Google ad preferences) and through industry tools such as optout.aboutads.info. Where required by law, we honor the Global Privacy Control (GPC) browser signal as a valid opt-out of targeted advertising. Our Site does not guarantee a response to other “Do Not Track” signals.
5. Payment Processing
Payments are processed by our third-party payment processor. When you make a payment, your card or bank information is collected and processed directly by the processor under its own privacy and security practices. We do not store complete payment card numbers on our systems. We encourage you to review the payment processor’s privacy policy.
6. Email and Text Message (SMS) Communications
If you provide your phone number or email and opt in, we may send you transactional messages (such as booking confirmations and reminders) and, where permitted, marketing messages about classes, promotions, and events. Message and data rates may apply to text messages. You may opt out of marketing emails by clicking “unsubscribe” and opt out of text messages by replying STOP. You may continue to receive transactional messages necessary to deliver the Services even after opting out of marketing. Our SMS program terms are set out in our Terms of Service.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
7. Photography, Video, and Social Media
We may photograph or record classes, events, and the studio environment for marketing, social media, and promotional use, consistent with the consent you provide in our liability waiver or on-site signage. If you do not wish to appear in our marketing materials, please notify a staff member or opt out through the waiver, and we will make reasonable efforts to honor your request. When you interact with our social media accounts, your activity is also governed by those platforms’ privacy policies.
8. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect your personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.
9. Data Retention
We retain personal information for as long as needed to provide the Services, maintain your account and membership history, comply with our legal obligations (including tax, accounting, and liability-record requirements), resolve disputes, and enforce our agreements. When information is no longer needed, we
take reasonable steps to delete or de-identify it. Security-camera footage is retained for a limited period and then overwritten in the ordinary course, except where preserved for an investigation or as required by law.
10. Your Privacy Rights
Depending on your state of residence, you may have rights regarding your personal information, and we honor these rights as required by applicable law. These may include the right to access a copy of your information, to correct inaccurate information, to request deletion (subject to legal exceptions), to opt out of targeted advertising or the “sharing” of personal information, and not to be discriminated against for exercising your rights.
Regardless of where you live, you may always opt out of marketing emails (unsubscribe), text messages (reply STOP), and interest-based advertising (see Section 4). We will verify your request and respond as required by law, and you may designate an authorized agent to make a request on your behalf. Note: as of the effective date, Louisiana does not have a comprehensive consumer data privacy statute; we honor rights to the extent required by the laws of the states where our clients reside.
11. Children’s Privacy
Our Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. Consistent with our Terms of Service, clients aged 16 or 17 may participate only with a parent or legal guardian who provides information and consent on the minor’s behalf; we do not admit participants under 16. If you believe we have collected information from a child without appropriate consent, please contact us so we can address it.
12. Third-Party Links and Services
Our Site and communications may contain links to third-party websites and services that we do not control. This Privacy Policy does not apply to those third parties, and we are not responsible for their practices. We encourage you to review their privacy policies.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Policy.
