Terms of Service & Studio Policies

These Terms of Service and Studio Policies (the “Terms”) are a binding agreement between Form Theory, LLC, doing business as Aligné Studios (“Aligné,” the “Studio,” “we,” “us,” or “our”), and you (“you,” the “client,” or “member”). They govern your purchase and use of classes, memberships, packages, and other services (collectively, the “Services”) at 300 Allen Toussaint Blvd, New Orleans, Louisiana, and through our website and booking platform. By creating an account, purchasing, reserving a class, or entering the Studio, you agree to these Terms.
1. Eligibility & Accounts
You must be at least 18 years old to create an account and purchase Services. Clients aged 16 or 17 may participate only with a parent or legal guardian who signs our Release of Liability, Assumption of Risk, Waiver & Indemnity Agreement and accepts these Terms on the minor’s behalf; we do not admit participants under the age of 16. You agree to provide accurate, current information, to keep your account credentials confidential, and to be responsible for all activity under your account. You must complete our waiver before participating.
2. Class Reservations, Waitlists & Check-In
Booking. Classes are reserved in advance through our booking platform and are subject to availability and class capacity. A spot is confirmed only when a class credit, package, or membership is applied at booking.
Waitlist. If a class is full, you may join the waitlist. If a spot opens, you may be automatically enrolled and notified; the cancellation and no-show rules in Section 3 then apply to that reservation.
Arrival & check-in. Please arrive at least 5 minutes before class to check in and set up. If it is your first visit, please arrive 10 minutes early so we can orient you to the equipment.
Grip socks & attire. Grip socks are required for all Lagree and reformer (Megaformer) classes for your safety and are available for purchase at the Studio. Grip socks are recommended but not required for mat and yoga classes.
3. Cancellation, Late Arrival & No-Show
Because our classes have limited capacity — including only eight spots in our Lagree room — timely cancellation allows us to offer your spot to another client.
Free cancellation: cancel at least 12 hours before the class start time, with no charge, and your class credit is returned.
Late cancellation (less than 12 hours before class): a $15 late-cancellation fee applies, and the class credit is forfeited.
No-show (failure to attend a reserved class without cancelling): a $20 no-show fee applies, and the class credit is forfeited.
Late arrival. For the safety of all participants, we hold your reserved spot for up to 5 minutes after the class start time. If you arrive more than 5 minutes after start, we cannot admit you to the class, and the reservation is treated as a no-show under this Section.
Fees are charged to the payment method on file. For members on unlimited or recurring plans, the applicable fee is charged even though no class credit is deducted.
Repeated late cancellations or no-shows may, at our discretion, result in restrictions on advance booking privileges. We may waive fees in cases of documented emergency at our sole discretion.
4. Memberships
We offer memberships on the following commitment terms, at the rates posted at the Studio and on our website:
Month-to-Month — recurring monthly membership with no minimum commitment beyond the current paid month.
3-Month, 6-Month, and 12-Month — discounted recurring memberships in exchange for a minimum commitment of the stated term.
Auto-renewal. All memberships bill automatically on a recurring basis to your payment method on file until cancelled in accordance with Section 5. At the end of a 3-, 6-, or 12-month term, the membership automatically renews for another term of the same length at the then-current rate unless you decline renewal as described in Section 5.
Minimum commitment. By purchasing a 3-, 6-, or 12-month membership, you commit to the full term and remain responsible for all payments for that term even if you stop attending. Term memberships cannot be cancelled before the end of the committed term (see Section 5).
Membership freezes. Members may freeze their membership for up to 30 days per calendar year at no charge. Freeze requests must be submitted in advance. A freeze extends any term commitment by the length of the freeze.
Benefits. Membership benefits, class allotments, and guest privileges are as described at the time of purchase and may be updated on a prospective basis.
5. Membership Cancellation
Month-to-month and founding memberships
To cancel a month-to-month or founding membership, submit written notice (by email or another method we designate) at least 10 days before your next scheduled billing date. Cancellation takes effect at the end of the current paid period; you retain access through that date. Requests received fewer than 10 days before the next billing date take effect the following cycle, and that cycle will still be charged.
Founding note. Founding memberships may be cancelled on this same basis; however, once a founding membership is cancelled, the locked founding rate is forfeited and cannot be reinstated.
Term memberships (3, 6, or 12 month)
A term membership cannot be cancelled before the end of its committed term. You may, however, decline the automatic renewal by giving written notice at least 10 days before the end of your committed term; otherwise the membership renews for another term of the same length. Early termination before the end of the committed term is not available except where required by law or, at our sole discretion, for a documented qualifying medical reason.
6. Class Packages & Credits
Single classes (drop-ins) and class packages are available for purchase at the rates posted at the Studio and on our website. Unless otherwise stated at the time of purchase, class credits expire as follows, measured from the date of purchase:
Drop-in (single class): 30 days
5-class pack: 45 days
10-class pack: 2 months
20-class pack: 4 months
Class credits are non-transferable. Expired credits have no cash value and will not be reinstated except at our discretion. Refund requests are handled as described in Section 8.
7. Pricing, Billing & Payment
You authorize us and our payment processor to charge your payment method on file for all purchases, recurring membership fees, applicable taxes, and any late-cancellation, no-show, or other fees you incur.
You are responsible for keeping your payment information current. If a payment fails, we may retry the charge, suspend your membership or access, and you remain responsible for amounts due. Declined or chargeback amounts may incur additional fees.
We may change pricing, class formats, schedules, and offerings at any time. Price changes to existing recurring memberships will be applied on a prospective basis with reasonable advance notice.
Promotional rates, intro offers, and founding-member pricing are subject to their specific terms and eligibility.
8. Refunds
Memberships, class packages, single classes, credits, and fees are generally non-refundable and non-transferable. We review refund requests individually, on a case-by-case basis, and may grant a refund or credit at our sole discretion; granting one request does not obligate us to grant another. We do not provide automatic refunds or credits for unused classes, missed classes, or partial billing periods.
9. Studio Etiquette & Code of Conduct
To preserve the serene, intentional environment that defines Aligné, we ask every client to:
Arrive early and be present;
Move with intention, and respect the space and each other;
Silence mobile devices and help keep the studio calm and quiet;
Follow all instructor guidance, posted rules, and safe-use instructions for the equipment;
Maintain proper hygiene, wipe down equipment after use, and return props to their place;
Refrain from harassment, intoxication, unsafe conduct, or any behavior that disturbs or endangers others.
10. Right to Refuse or Terminate Service
We reserve the right, in our sole discretion, to refuse service, cancel a reservation, suspend or terminate an account or membership, and remove any person from the premises for violation of these Terms, unsafe or disruptive conduct, non-payment, or any conduct we determine is contrary to the Studio environment. Where we terminate for cause, no refund is owed.
11. Health, Safety & Assumption of Risk
Participation in our Activities is physically demanding and carries inherent risks. You are responsible for exercising within your own limits and for consulting a physician before beginning. These Terms incorporate by reference our separate Release of Liability, Assumption of Risk, Waiver & Indemnity Agreement, which you must sign before participating. In the event of any conflict regarding liability, the signed waiver controls.
12. Photography & Media
We may photograph and record classes, events, and the studio environment for marketing, social media, and promotional use. If you do not wish to appear in our marketing materials, you may opt out at any time through our waiver or by notifying a staff member, and we will make reasonable efforts to honor your request.
13. Intellectual Property
The Aligné and Aligné Studios names, logos, class formats, programming, content, and materials are the property of Form Theory, LLC or its licensors and are protected by applicable law. You may not record, reproduce, distribute, or commercially use our classes, content, or branding without our prior written consent.
14. SMS / Text Messaging Program
If you opt in to receive text messages from us, the following terms apply to our SMS program:
1. Program Description
By opting in, you agree to receive recurring automated text messages from Aligné Studios (“we,” “us,” “our”) at the mobile number you provided. Messages may include appointment and class reminders, booking and account updates, customer support follow-ups, and occasional promotional offers. Consent to receive these messages is not a condition of any purchase.
2. Message Frequency
You may receive up to 6 messages per month. Message frequency may vary depending on your activity and interactions with us.
3. Message and Data Rates
Message and data rates may apply. Charges are billed by and payable to your mobile service provider. Please contact your wireless carrier for details about your messaging plan.
4. How to Opt Out and Get Help
You can unsubscribe from the SMS service at any time by replying STOP to any message we send you. After you send STOP, you will receive a one-time confirmation message, and no further messages will be sent. If you want to rejoin, you can sign up again using the original opt-in method or reply START. For help or more
information at any time, reply HELP to any of our messages. You can also contact our support team directly at info@alignestudios.co.
5. Carrier Liability Disclaimer
Carriers are not liable for any delayed or undelivered messages.

15. Limitation of Liability & Indemnification
To the fullest extent permitted by Louisiana law, our total liability arising out of or relating to the Services or these Terms shall not exceed the amount you paid to us in the three (3) months preceding the event giving rise to the claim, and we shall not be liable for indirect, incidental, special, or consequential damages. Nothing in these Terms limits liability that cannot be limited under Louisiana law (including Louisiana Civil Code article 2004 regarding physical injury and gross or intentional fault). You agree to indemnify and hold us harmless from claims arising out of your breach of these Terms or misuse of the Services, as further described in the signed waiver.
16. Governing Law & Disputes
These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles. Any dispute shall be brought exclusively in the state or federal courts located in Orleans Parish, Louisiana, and you consent to their jurisdiction. If any provision is found unenforceable, it will be modified or severed to the minimum extent necessary and the remainder will remain in effect.
17. Changes to These Terms
We may update these Terms from time to time. We will revise the “Last Updated” date and, where appropriate, provide notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
